Terms of Service
The short version. This is the plain-language summary; the full terms below control.
- We provide research and strategy for college cheer recruiting. We don't guarantee admission, a roster spot, a scholarship or any amount of aid.
- Costs, requirements and deadlines come from public sources and can change; confirm with each school before you rely on them.
- The parent or guardian completes the intake and buys the products, not the athlete.
- The Playbook can be refunded within 14 days if you haven't downloaded it. The Compass can be refunded in full until we start your research.
- Your report is for your family's personal use.
1. Who we are and these terms
These Terms of Service (the "Terms") are an agreement between you and Wittie Consulting, LLC, doing business as College Cheer Compass ("we," "us"). They apply to our website, the intake form, and the products and services we sell, including the Compass Report, the College Cheer Playbook and the Annual Refresh (together, the "Services"). By using the Services or making a purchase, you agree to these Terms and to our Privacy Policy.
2. Who may use the Services
You must be at least 18 years old. The Services are designed for parents and legal guardians of student athletes. If you provide information about an athlete who is a minor, you confirm you are that athlete's parent or legal guardian, or have their permission. The Services are not directed to children.
3. What we provide, and what we don't
3.1 Research and strategy only
Our products are educational research and planning tools. They are not admissions counseling from a licensed or credentialed counselor, financial, tax or legal advice, or a recruiting or athlete-agent service. Decisions about where to apply, try out, enroll or spend money are yours.
3.2 No guarantees
We do not guarantee, and nothing we provide promises, that any athlete will be admitted to a college, selected for a team, offered a scholarship or aid, or receive any particular cost or outcome. Admission, tryouts, roster spots and aid are decided solely by each school and its staff.
3.3 Accuracy of information
We research costs, scholarships, tryout requirements, results and deadlines from official school and athletics sources and other public sources, and we date and cite what we find. This information changes often and may be incomplete or out of date by the time you read it. Estimated costs are estimates, not quotes. Always confirm details directly with the school before you rely on them. Where we identify a figure as coming from a third-party source, treat it with extra care.
3.4 No affiliation
We are an independent business. We are not affiliated with, endorsed by or sponsored by any college or university, athletic conference, Varsity Spirit, UCA, NCA or other cheer organization. Their names are used only to describe and identify them.
4. Your information and the intake form
You agree that the information you give us is accurate and that you have the right to share it. The quality of a report depends on the accuracy of the intake. How we use and protect that information is described in our Privacy Policy.
5. Coach introductions
If your package includes coach introductions, we only contact coaches you select, using a message and athlete profile you approve before it's sent. A coach's response, or lack of one, is entirely up to the coach. We don't guarantee any response, evaluation or offer.
6. Purchases, delivery and refunds
- Prices are shown in U.S. dollars at checkout and may change, but a change won't affect an order you've already paid for. Payments are processed by our checkout provider, which may act as the merchant of record and collect any applicable sales tax.
- Delivery. The Playbook is delivered digitally right after purchase. The Compass is delivered within 5 business days after we receive a complete intake, unless we tell you otherwise.
- Playbook refunds. You may request a full refund within 14 days of purchase if you haven't downloaded the Playbook.
- Compass refunds. You may cancel for a full refund any time before we begin researching your report. Once research has begun, the Compass is a custom service and isn't refundable, except as follows: if your report contains a material factual error, tell us within 30 days of delivery and we'll correct it within 5 business days; if we can't, we'll refund your purchase.
- Annual Refresh. If you buy the optional Annual Refresh, we'll tell you before you're charged for a renewal and how to cancel. You can cancel any time before the renewal date.
- To request a refund or correction, email louiswitsiepe@gmail.com with your reference number.
7. Who may use your report and our materials
We grant you a personal, non-transferable license to use your report, the Playbook and our materials for your own family's recruiting. You may share your report with your athlete, family members and the coaches you're working with. You may not resell, publish, or distribute our materials or reports, or use them to build a competing product. We keep all rights in our content, research methods, databases, designs and brand.
8. Acceptable use
Don't misuse the Services: no automated scraping, attempting to access our systems or data you're not authorized to access, submitting false information, or using the Services to harass anyone.
9. Partner links and disclosure
Some people who recommend our products are members of our Partner Program and earn a commission when you buy through their link. Partners are required to tell you this. A partner's recommendation is their own, and the price you pay is the same whether or not you use a partner link (unless a partner offers you a discount code).
10. Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Some states don't allow these exclusions, so they may not apply to you.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost opportunities, admissions, scholarships, aid or tuition, arising from the Services. Our total liability for any claim related to the Services is limited to the amount you paid us for the Service the claim relates to. Nothing in these Terms limits liability that can't be limited by law.
12. Indemnity
You agree to indemnify us against claims arising from information you provided that you didn't have the right to share, or from your breach of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. If you have a concern, email us first; most problems can be solved quickly. Either of us may bring a qualifying claim in small-claims court. Otherwise, any lawsuit must be brought in the state or federal courts located in Cobb County, Georgia.
14. Changes
We may update these Terms. We'll post the new version here with a new effective date. Changes don't apply to purchases made before the change.
