Partner Program Terms
The short version. This is the plain-language summary; the full terms below control.
- You earn 10% to 20% on sales you refer, based on how many qualifying sales you make in the calendar year.
- You must clearly disclose that you earn a commission, every time you promote us.
- Never promise a roster spot, admission, scholarship or dollar amount, and never imply a school, coach or Varsity endorses us.
- Commissions are paid after the 30-day refund window. Self-purchases, refunds and fraud don't earn.
- You're an independent partner, not an employee. Either side can end this at any time.
1. About these terms
These Partner Program Terms (the "Terms") are an agreement between you and Wittie Consulting, LLC, doing business as College Cheer Compass ("we," "us"). They govern your participation in our affiliate and referral program (the "Program"). By applying to, or participating in, the Program you agree to these Terms. If you're applying on behalf of a business, such as a gym, you confirm you can bind that business to these Terms.
2. Eligibility and approval
- You must be at least 18 years old and able to enter into a contract.
- We review every application and may accept or decline it for any reason. We may require you to complete onboarding with our payment and tracking provider, including identity and tax information.
- Athletes who are minors may not be partners. Their parent or guardian may apply on their own behalf.
3. Your partner link
Once approved, you'll receive a unique referral link and, if we offer them, a referral code. A sale is credited to you when a customer clicks your link and completes a purchase within 30 days of their most recent click, as recorded by our tracking system. If a customer clicks more than one partner's link, the most recent click receives credit. Our tracking records are final, except in cases of clear technical error that we confirm.
4. Commissions
4.1 Qualifying sales
A "qualifying sale" is a completed, paid purchase of the Compass Report or the College Cheer Playbook made by a new customer through your link, that is not refunded, charged back or cancelled within the 30-day hold period. Other products and add-ons, including the Annual Refresh, do not earn commission unless we say so in writing.
4.2 The commission ladder
Your commission rate depends on the number of qualifying sales credited to you during the current calendar year:
- Starter: 10% for qualifying sales number 1–15 in a calendar year.
- Builder: 13% for qualifying sales number 16–30 in a calendar year.
- Pro: 16% for qualifying sales number 31–50 in a calendar year.
- Elite: 20% for qualifying sales number 51 and up in a calendar year.
When a qualifying sale moves you into a new tier, that sale and all later qualifying sales in the same calendar year earn the new rate. Rates are not applied retroactively to earlier sales. Your count resets to zero on January 1 each year.
4.3 How commission is calculated
Commission is calculated on the amount the customer actually paid for the product, after discounts and before sales tax, excluding taxes, payment-processing fees and refunds.
4.4 Sales that never earn
- Purchases by you, your household, or for your own athlete.
- Purchases that are refunded, charged back, cancelled or found to be fraudulent, at any time. If a commission was already paid on such a sale, we may deduct it from future payouts.
- Sales generated in breach of these Terms, including through prohibited promotion methods.
5. Payment
- Commissions are paid monthly, through our checkout and payouts provider, for qualifying sales that have cleared the 30-day hold period, once your unpaid balance is at least $50. Balances below that roll over to the next month.
- You're responsible for providing accurate payout and tax information. You're responsible for your own taxes. Our provider or we may issue tax forms (such as IRS Form 1099) where required.
- Any fees charged by your payout method are yours.
6. How you may promote us
6.1 Required disclosure
You must clearly and conspicuously disclose your relationship with us every time you promote us, as required by the Federal Trade Commission's Endorsement Guides. Use plain words such as "#ad," "Paid partner," or "I earn a commission if you buy through my link," placed before or right next to the link, visible without clicking "more," and spoken aloud in video or audio content.
6.2 Truthful claims only
- Describe our products accurately and only as described on our website.
- Do not promise or suggest that a family will make a team, gain admission, receive a scholarship, or save a specific amount of money.
- Share only your honest opinions and experiences.
6.3 Prohibited methods
- Spam: unsolicited bulk email, text messages or direct messages, or messages that violate the CAN-SPAM Act or the Telephone Consumer Protection Act.
- Bidding on our brand names ("College Cheer Compass," "Compass Report," "College Cheer Playbook," "The Path to College Cheer," or close variations) in paid search, or registering domains or social accounts that include them.
- Using the names, logos or marks of any college, conference, Varsity Spirit, UCA, NCA or other organization in a way that suggests they endorse or partner with us.
- Directing marketing to minors, or collecting personal information from children.
- Coupon or deal sites, cookie stuffing, or any method that credits you for sales you didn't genuinely refer.
- Content that is misleading, defamatory, discriminatory, harassing, or that infringes anyone's rights.
6.4 Our brand
We grant you a limited, revocable, non-exclusive license to use our names, logos and the materials in our partner kit only to promote the Program under these Terms. You may not alter our logos. All goodwill from that use belongs to us. The license ends when your participation ends.
7. Independent relationship
You are an independent contractor. Nothing in these Terms creates an employment, partnership, joint-venture, franchise or agency relationship. You may not make commitments or speak on our behalf, and you're responsible for your own expenses.
8. Ending participation
Either of us may end your participation at any time, for any reason, by notice (email is enough). If you end it, or we end it without cause, we'll pay commissions earned on qualifying sales made before the end date once they clear the hold period. If we end it because you breached these Terms, unpaid commissions are forfeited.
9. Changes to the Program
We may change commission rates, tiers, eligible products or these Terms by posting the update and emailing active partners. Changes apply to sales made after the effective date of the change. If you keep participating after that date, you accept the changes.
10. Confidentiality and customer data
You won't receive customers' personal information through the Program. If you do learn non-public information about our business or customers, keep it confidential and don't use it except to participate in the Program.
11. Disclaimers and limits of liability
The Program and our tracking are provided "as is." We don't guarantee any level of sales or earnings, or that tracking will be uninterrupted or error-free. To the fullest extent the law allows, neither of us is liable to the other for indirect, incidental, special or consequential damages, and our total liability to you under these Terms is limited to the commissions owed to you in the 12 months before the claim.
12. Indemnity
You agree to defend and indemnify us against claims, losses and costs (including reasonable attorneys' fees) arising from your promotional content, your breach of these Terms, or your violation of any law, including advertising, disclosure and anti-spam laws.
13. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Before filing any claim, each of us agrees to try to resolve the dispute informally by written notice and a good-faith discussion for at least 30 days. Any lawsuit must be brought in the state or federal courts located in Cobb County, Georgia, and each of us consents to those courts' jurisdiction.
14. General
These Terms are the entire agreement about the Program. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of our business.
